California State Assemblymember Kevin Kiley, a frequent critic of Gov. Gavin Newsom, and author of "Recall Newsom," posted news of the Supreme Court's recent ruling on banning indoor worship gatherings.
“The Supreme Court has struck down Gov. Newsom's ban on indoor church services,” Kiley wrote on Twitter.
He said that Chief Justice Roberts commented that it “appears to reflect not expertise or discretion, but instead insufficient appreciation or consideration of the interests at stake.”
The high court ruled in two cases – Harvest Rock church, et al. versus Newsom, Gov. of California, and South Bay United Pentecostal Church, et al., V. Gavin Newsom, Governor of California, et al, which both ruled that banning indoor church services violated the Constitution's protection of the free exercise of religion.
The chief justice also said that "the state's present determination -- that the maximum number of adherents who can safely worship in the most cavernous cathedral is zero.”
The court ruling was a 6-3 decision.
Justice Elena Kagan, who dissented, said “The court orders California to weaken its restrictions on public gatherings by making a special exception for worship services.”
Kiley had also won a lawsuit, together with Assemblyman James Gallagher, against the governor, alleging Newsom abused his emergency powers and violated the Constitution.
